BY CLICKING THE "AGREE" BUTTON, YOU ARE CONSENTING TO BE BOUND BY AND ARE BECOMING A PARTY TO THIS AGREEMENT.

This Agreement sets forth the terms and conditions of your BXDX membership. By accepting this Agreement, you certify and agree to the following:


1. You are at least eighteen (18) years of age and have the legal right to possess adult material in your community, and in all respects are qualified and competent to enter into this Agreement.

2. You do not find images of nude adults, adults engaging in sexual acts, or other sexual material to be offensive or objectionable.

3. You understand the standards and laws of the community, site and computer to which you are transporting this material and are solely responsible for your actions.

4. If you use the services in violation of the herein Agreement, you understand that you may be in violation of local and federal laws and are solely responsible for your actions. By logging onto participating sites, you will have released and discharged the providers, owners and creators of this site from any and all liability which might arise.

5. Instant access to the membership will be granted upon your successful purchase of a one-month paid BXDX membership. Your paid membership will renew monthly at the current rate or until you cancel your membership. All monthly subscriptions are automatically renewed at the end of each month, unless you submit notice of cancellation.

6. By enrolling in the BXDX service, you become a Member and agree to be bound by this Agreement. This Agreement is subject to change by BXDX at any time.

7. Access to and use of the service is through a combination of an login and a password. The Member is required to keep his or her password secret and may not disclose his or her account information. BXDX will not release your information for any reason, except as may be specifically required by law or court order.

8. Membership may not be assigned or transferred to any other person or entity.

9. BXDX membership may be terminated at any time and without cause by either BXDX or the Member upon notification of the other by electronic mail. Members are liable for charges incurred by them until termination of the service.

10. Any liability of BXDX including, without limitation, any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, alteration of, or use of records, whether for breach of contract, tortious behavior, negligence or under any other cause of action, shall be strictly limited to the amount paid by or on behalf of the Member to BXDX for the preceding twelve (12) months.

11. No warranty is made by BXDX regarding any information, services or products provided through or in connection with the service and BXDX hereby expressly disclaims any and all warranties, including without limitation: (i) any warranties as to the availability, accuracy or content of information products or services; (ii) any warranties of merchantability or fitness for a particular purpose.

12. All responsibility or liability for any damages caused by viruses contained within the electronic files or at this site or any participating sites is disclaimed.

13. BXDX makes no representation that materials on any participating sites are appropriate or available for use in other locations, and accessing them from territories where their contents are illegal is prohibited. Those who chose to access participating sites from other locations do so on their own initiative and are responsible for compliance with local laws.

14. This site contains links to other Internet sites. Such links are not endorsements of any products or services in such sites, and no information in such site has been endorsed or approved by BXDX. BXDX does not actively review or monitor these sites and is in no way responsible for their content.

15. Member agrees to indemnify, defend and hold harmless BXDX from any liability, loss, claim and expense, including attorneys' fees and expenses, related to the Member's violation of the on-line agreement or use of this site.

16. All memberships are for personal use and shall not be used for any commercial purposes or by commercial entities. Commercial use of either the site or any material found within the site is strictly prohibited. No material within the site may be transferred to any other person or entity, whether commercial or non-commercial. In addition, materials may not be modified or altered. Materials may not be displayed publicly, or used for any rental, sale, or display. Materials shall extend to and include copyright, trademarks, or other proprietary information. BXDX reserves the right to terminate this license at anytime if the terms of this agreement are violated.

17. Member agrees that the unauthorized downloading or other duplication of materials from participating sites is expressly forbidden under the terms of this Agreement. Member agrees to be personally liable and fully indemnify BXDX for any and all damages directly, indirectly and/or consequently resulting from any attempted or actual unauthorized downloading or other duplication of materials from participating sites.
